Privacy Policy

1. Introduction

TalkWise ("we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI voice agent platform and related services (the "Service"). By using the Service, you consent to the practices described in this policy.

2. Information We Collect

Account Information

When you register, we collect your name, email address, company name, phone number, and billing information.

Usage Data

We automatically collect information about how you use the Service, including pages visited, features used, call volumes, agent configurations, and dashboard interactions.

Call Data

When your AI agents make or receive calls through the Service, we process call metadata (duration, timestamps, phone numbers), call recordings (if enabled), and transcriptions. You control whether recordings and transcriptions are stored.

Technical Data

We collect device information, browser type, IP address, and similar technical data through cookies and similar technologies to ensure the Service functions properly.

3. How We Use Your Information

We use collected information to: provide and maintain the Service; process transactions and send billing notifications; analyze usage to improve features and performance; provide customer support; send service-related communications; comply with legal obligations; and detect and prevent fraud or abuse.

4. Call Recording & Transcription

Call recordings and transcriptions are stored securely and are accessible only to you and authorized members of your organization. TalkWise does not listen to, review, or share your call recordings except when required by law or when you explicitly request support assistance. You are responsible for complying with call recording consent laws in your jurisdiction.

5. Data Sharing

Service Providers

We share data with third-party providers who help us operate the Service, including cloud hosting (AWS), telephony providers, payment processors (Stripe), and analytics tools. These providers are bound by data processing agreements.

Legal Requirements

We may disclose information if required by law, subpoena, or government request, or to protect the rights, property, or safety of TalkWise, our users, or the public.

Business Transfers

In the event of a merger, acquisition, or sale of assets, your information may be transferred to the successor entity. We will notify you of any such change.

6. Data Retention

We retain your account information for as long as your account is active. Call recordings and transcriptions are retained according to your account settings (default: 90 days). You may delete your data at any time through the dashboard. Upon account termination, we delete your data within 30 days, except where retention is required by law.

7. Data Security

We implement industry-standard security measures to protect your data, including encryption in transit (TLS 1.3) and at rest (AES-256), access controls, regular security audits, and SOC 2 Type II compliance. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

8. Your Rights (General)

Depending on your jurisdiction, you may have the right to: access the personal data we hold about you; correct inaccurate data; request deletion of your data; export your data in a portable format (JSON or CSV); opt out of marketing communications; restrict or object to certain processing; and withdraw consent where processing is based on consent. To exercise any of these rights, contact us at privacy@talk-wise.ai. We will respond to verified requests within 30 days.

9. GDPR Rights (European Economic Area)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have additional rights under the General Data Protection Regulation (GDPR). Our legal bases for processing include: performance of a contract (to provide the Service), legitimate interests (to improve and secure the Service), consent (for optional analytics and marketing), and legal obligations. You have the right to lodge a complaint with your local supervisory authority. For enterprise customers, we offer a Data Processing Agreement (DPA) that covers our obligations as a data processor under GDPR, including Standard Contractual Clauses for international transfers. Contact legal@talk-wise.ai to request a signed DPA.

10. CCPA Rights (California)

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). You have the right to: know what personal information we collect and how it is used; request deletion of your personal information; opt out of the sale or sharing of your personal information; and not be discriminated against for exercising your rights. TalkWise does not sell personal information. To submit a verifiable consumer request, contact us at privacy@talk-wise.ai. We will verify your identity before processing requests. You may also designate an authorized agent to make requests on your behalf.

11. Data Processing Agreement

For enterprise and business customers, TalkWise offers a Data Processing Agreement (DPA) that governs our processing of personal data on your behalf. The DPA includes: the scope and purpose of processing, data subject categories, our obligations as a data processor, sub-processor management, data breach notification procedures, and audit rights. Our standard DPA is available upon request at legal@talk-wise.ai and is compliant with GDPR Article 28 requirements.

12. Sub-Processors

TalkWise uses the following categories of sub-processors to deliver the Service: cloud infrastructure providers (for hosting and storage), telephony and communications providers (for call routing and delivery), payment processors (for billing), analytics providers (for Service improvement), and email delivery services (for notifications). We maintain a current list of sub-processors and will notify customers of any material changes. All sub-processors are bound by data processing agreements that provide protections no less stringent than those in our DPA. Enterprise customers may subscribe to sub-processor change notifications through their account settings.

13. International Transfers

Your data may be processed in countries other than your own, primarily in the United States. We ensure appropriate safeguards are in place for international transfers, including Standard Contractual Clauses (SCCs) approved by the European Commission, adequacy decisions where available, and supplementary measures where required. You may request information about the specific safeguards applied to your data by contacting privacy@talk-wise.ai.

14. Cookies & Tracking

We use essential cookies to operate the Service (authentication, session management, security) and optional analytics cookies to understand usage patterns. We do not use third-party advertising cookies or cross-site tracking. You can manage cookie preferences through your browser settings or through our in-app cookie consent banner. Disabling essential cookies may impair the functionality of the Service. For more details, see our cookie notice available in the Service dashboard.

15. Children's Privacy

The Service is not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have collected data from a child, we will delete it promptly and notify the relevant account holder.

16. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. We encourage you to review this policy periodically. Your continued use of the Service after changes take effect constitutes acceptance. Previous versions of this policy are available upon request.
